I am proud to have participated in this round table organized by Confilegal on Artificial Intelligence and the legal world: Is it a train we are obliged to board? In this meeting, I had the opportunity to share my thoughts and learn from other experts in the field of compliance, a sector that is constantly evolving and must be prepared to adapt to new technologies and challenges posed by artificial intelligence in the legal world.

The legal world is experiencing a paradigm shift with the incorporation of legal technology, known as legaltech. This term encompasses the use of innovative technologies and digital solutions to automate, streamline, and improve legal processes and the provision of legal services.

Generative Artificial Intelligence in the Legal Field

Generative Artificial Intelligence is a technology that mimics the way the human brain works. It analyzes and summarizes documents, generates new ones, makes predictions based on case law and historical data of cases and court rulings, and efficiently identifies relevant documents in large data sets, saving time and costs.

The Need for Adaptation to Change

Legal professionals must adapt to these changes and board the train of Artificial Intelligence. Resistance to change is common in legal professions, but it is necessary to carry out a process of implementing technological solutions that involves the protagonists and convinces them of the benefits they will obtain in their profession.

Training in New Methodologies and Technologies

Technical legal training is no longer enough. Lawyers must master new methodologies such as design thinking, project management, and time management. In addition, it is necessary to understand non-legal concepts such as user experience and learn about the law of technologies.

In the vast world of data available on the internet, there is a lack of clear discrimination between good and bad data. As we progress in our queries and refine our questions, we educate the system, which in turn advances. However, the human head is still needed to filter the results.

Expert systems are essential tools that should be implemented in all legal fields, from town halls to autonomous communities. These systems use algorithms and data, but also incorporate human knowledge, creating decision trees that facilitate legal decision-making.

In addition, it is crucial to comply with data protection laws and ensure that customer information is handled securely and confidentially.

As laws and regulations adapt to this new reality, new possibilities will open up to improve efficiency and transparency in the legal system. Standardizing legal language and integrating it with computing are key steps towards a future where artificial intelligence plays a fundamental role in the legal field.

Justice in Spain, with its 45,000 officials and multiple recent strikes, faces a crucial moment of change. Artificial intelligence and legaltech are changing the way we work, and it is necessary to redefine roles within justice. Judicial assistance bodies, for example, are specializing in handling computer elements in the courtroom, which shows an evolution in their functions.

Robotization of Procedures

Artificial intelligence can be used to robotize procedures, such as monitories, thus speeding up the process and requiring a redefinition of the map of material and human resources. This could lead to proposals for sentences generated by artificial intelligence, which the judge can accept or modify.

Quality of Sentences and Neutrality of Judges

Artificial intelligence can also be used to assess the quality of sentences of magistrates and the neutrality of judges. Although it is technically possible, a serious debate is required on the criteria that will be used to evaluate these issues.

The Need for a Paradigmatic Change in Justice

The introduction of technology into the judicial system should not be a simple addition to a system that has fundamental flaws. A paradigmatic change is needed in the way laws and justice are approached in general. Artificial intelligence can be a valuable tool in this process, but it is crucial that it is used ethically and human-centered. Technology must be a tool that helps us improve, not one that controls or replaces us.
